These Terms of Service ("Terms") are a binding agreement between you and SANDBAGR L.L.C., a New Jersey limited liability company that operates SANDBAGR ("SANDBAGR," "we," "us," or "our"). They govern your use of the SANDBAGR mobile application, our website at sandbagrapp.com, and related services (together, the "Service").
By creating an account, joining the waitlist, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 18 years old and capable of forming a binding contract to use the Service. By using the Service, you represent that you meet these requirements and that you will comply with all laws that apply to you, including any laws governing wagering or gaming in your location.
You are responsible for the information you provide and for all activity that occurs under your account. Keep your login credentials secure and notify us promptly at team@sandbagrapp.com if you suspect unauthorized use. We may suspend or terminate accounts that violate these Terms.
SANDBAGR is a social scorekeeping and record-keeping tool. It lets groups of people who already know each other organize golf rounds, track scores, set up friendly side games, and keep a running record of who owes whom. The Service is designed to help friends keep score and settle up among themselves.

The Service lets you create content, including group names, usernames, and the descriptions of custom side games or wagers ("User Content"). You are solely responsible for your User Content and represent that you have the right to post it and that it does not violate these Terms or any law.
The Service, including its software, design, branding, the SANDBAGR name and logo, and all related content we provide, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial use, subject to these Terms. You may not copy, modify, distribute, sell, or create derivative works from the Service except as expressly permitted.
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any records or calculations it displays will be accurate. You use the Service at your own risk.
To the maximum extent permitted by law, SANDBAGR L.L.C. and its owners, members, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or amounts owed between users, arising out of or relating to your use of the Service. In no event will our total liability for any claim relating to the Service exceed one hundred U.S. dollars (USD $100). Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
You agree to indemnify and hold harmless SANDBAGR L.L.C. and its owners and affiliates from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your User Content, your violation of these Terms, or your violation of any law or the rights of any third party, including any dispute between you and another user over a wager or settlement.
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Service will be resolved through binding individual arbitration, on an individual basis only, and you and we waive the right to a jury trial and to participate in a class action, to the extent permitted by law. Notwithstanding the foregoing, either party may bring an individual claim in small-claims court. If any part of this section is found unenforceable, the remainder will continue to apply.
You may stop using the Service at any time. We may suspend or terminate your access at any time, with or without notice, if we believe you have violated these Terms or to protect the Service or other users. Sections that by their nature should survive termination will survive.
The following additional terms apply when you access the Service through an application obtained from the Apple App Store ("App"):
We may update these Terms from time to time. When we do, we will revise the effective date above and, where appropriate, provide additional notice. Your continued use of the Service after changes become effective means you accept the updated Terms.
